Dual Funding Streams, Two Paths Toward Healing

The Delaware Opioid Settlement Commission is responsible for the accountable stewardship of two distinct funding streams established under Delaware Code 16 Del. C. § 5196A. While both support our mission to move Delaware forward, they represent separate funding sources with unique origins and specific programs.

Opioid Settlement Funds

These are obtained through legal settlements with pharmaceutical companies involved in the opioid crisis. These funds are designated to help communities recover and prevent future harm by expanding access to prevention, treatment, harm reduction, and recovery support services.

Opioid Impact Fee Funds

This separate state fund leverages “impact fees” from pharmaceutical manufacturers that sell high volumes of prescription opioids in Delaware. These fees ensure that those responsible for the crisis contribute to similar proven strategies supported by settlement funds.

How We Fund Opioid Abatement Strategies: Three Distinct Grant Programs

We distribute funding through three programs. While each path works differently, every project must be reviewed for alignment with the settlement agreement and approved by public vote.

Annual Community Grants

Open to nonprofits, state agencies, and local businesses. A diverse panel of experts score each application to ensure fairness, focusing settlement funding on the Delaware ZIP codes and communities hit hardest by the crisis.

Local Government Grants (Data-Driven)

A dedicated funding pool reserved for Delaware’s three counties and seven specific towns that participated in the settlement agreement. Settlement funds are calculated from a data formula based on local overdose and health statistics. Local leaders then submit plans to fulfill their specific needs.

Opioid Impact Fee Grants (Community-Led)

Launching in 2027, this program will be funded by a separate state account — the Opioid Impact Fee Fund. Currently being designed, it will be shaped entirely by the direct voices, needs, and experiences of those most affected by opioid use.
